8) Limitation of Liability
To the fullest extent permitted by law, Emerald Headline Education Ltd and its directors, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or related to your use of the Service.
To the extent that liability cannot be excluded, our total liability for claims arising out of or related to the Service will be limited to the greater of (a) the amount you paid to us for the Service in the 12 months immediately preceding the event giving rise to the claim, or (b) €100.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.
9) Indemnification
You agree to indemnify and hold harmless Emerald Headline Education Ltd from and against any claims, demands, losses, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, or your infringement of any intellectual property or other rights of any person or entity.
10) Force Majeure
We will not be liable for any delay or failure to perform resulting from events beyond our reasonable control, including natural disasters, acts of government, war, terrorism, civil unrest, labour disputes, internet or telecommunications outages, cyberattacks, or failures of hosting and cloud infrastructure providers.
11) International Use
The Service is intended primarily for the Irish market, but it may be accessed from other countries. We make no representation that the Service is appropriate or available for use in all jurisdictions. You are responsible for compliance with your local laws if you access the Service from outside Ireland.
12) Governing Law and Jurisdiction
These Terms are governed by the laws of Ireland, without regard to its conflict of laws principles. The courts of Dublin, Ireland will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service, except where mandatory consumer protection laws provide otherwise.
If you are a consumer based in the European Economic Area, you may also have rights under mandatory consumer laws in your country of residence.
13) Dispute Resolution

These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Emerald Headline Education Ltd regarding your use of the Service and supersede any prior agreements or understandings on the subject.
17) Assignment and No Waiver
We may assign or transfer these Terms, in whole or in part, in connection with a merger, acquisition, reorganisation, or sale of assets. You may not assign your rights or obligations under these Terms without our prior written consent.
Our failure to enforce any provision of these Terms will not be considered a waiver of our right to enforce that provision or any other provision.
18) Modifications to These Terms
We may update these Terms from time to time. Changes will be posted on this page and will become effective 14 days after posting, unless a change is required by law or relates to security, in which case it may take effect immediately. Your continued use of the Service after the effective date of an update indicates acceptance of the revised Terms.
19) Electronic Communications
By using the Service and communicating with us electronically, you agree that we may communicate with you electronically and that such communications satisfy any legal requirement that the communication be in writing.
